“UNB stated that (the APT`s certification application) was contrary to the previous agreement to create the PTSU, where we had to reach agreement on the members of the bargaining unit,” said John Hayden, former president of the PTSU and current head of the union`s complaints. ” (UNB) stated that a second adoption was contrary to this agreement. It really didn`t make sense, because basically they say that (the APT workers could have been involved in the previous journey), their right to organize had been negotiated away from them, which violates their human rights… People have the right to organize and create a union. Any agreement between (PTSU and UNB) cannot remove them,” Hayden added. UNB`s argument to refuse certification was based on an agreement on the scope of the PTSU bargaining unit. The goal was to add unrepresented APT workers to an existing union, PSAC`s Professional and Technical Staff Union (PTSU), Local 60551, which was certified in March 2013. This application has not yet been considered by the New Brunswick Labour and Employment Council, as UNB has made an interim objection. The chamber rejected the objection in April 2016, and unB conducted a judicial review of that decision, which ended with Judge Garnett`s decision on April 7, 2017.
